My name is Stefan Coleman and I am New Jersey bankruptcy lawyer.  I absolutely love my job because I am able to help so many people who are really struggling financially to get the relief and fresh start that our bankruptcy laws allow.  Bankruptcy has its origins as far back as the original Constitution.  Our founding fathers even then, realized that we needed to provide for honest, but unfortunate people who are saddled with debt, an opportunity to get a fresh start rather than be saddled with that debt for the rest of their lives.

Can I File and Still Keep My House and Cars?

Most of my clients who file bankruptcy keep all of their assets including their home, cars, household goods, and any other assets they might have.  The bankruptcy laws allow the debtor is filing to exempt i.e. keep his property up to a certain dollar amount even though he is filing for bankruptcy.  These laws are quite complex and changing all the time so it is important to speak to a bankruptcy attorney in New Jersey like me who knows how to best protect all of your assets.

Word of Caution Against Debt Settlement Companies

We’ve all heard them on the radio promising to settle your debt for pennies on the dollar.  What you don’t hear are all of the phone calls I receive after clients have worked with these companies for the last year.  In some cases, they have actually settled a credit card here and there but the fees that they retain for their work make the process totally worthless of your time and money.  Not only that but any debt they settle for you, you will be liable in taxes for that amount since the amount they settled will be treated as income.  On the other hand, when you file bankruptcy, your debts are not settled – they are literally wiped out to $0- and the debts that are wiped out are not treated as income for tax purposes.
